Notice of Privacy Practices

Healing Quest Psychotherapy LLC — Lucinda Moody, MSW, LICSW (Minnesota), LCSW (Wisconsin)

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

My commitment to your privacy

The services you receive concern your mental health, one of the most private parts of your life. Federal law (HIPAA) requires me to protect your health information, called “protected health information” or PHI, to give you this notice, and to follow it. When I use or share your information, I use or share only the minimum necessary.

Minnesota and Wisconsin law often protect mental health records more strictly than HIPAA does. For example, both states generally require your written consent before I share your records. Where state law gives you more protection, I follow the stricter law.

How I may use and share your information

  • Treatment: I share your information with other health care providers involved in your care only with your written authorization, except in a medical emergency.
  • Payment: I use and share information needed to bill you or your health insurance plan, such as diagnosis codes and dates of service.
  • Health care operations: I may use information to run my practice, such as billing, record-keeping, and quality review.

When I may share information without your authorization

The law allows or requires me to share information without your authorization in limited situations:

  • Abuse or neglect: to report suspected abuse or neglect of a child or vulnerable adult, as required by law
  • Serious threat to health or safety: to prevent a serious and imminent threat to you or someone else
  • Legal proceedings: in response to a court order or other lawful process, as permitted by state law
  • Health oversight: to licensing boards and government agencies that oversee health care
  • As otherwise required by law: including to the U.S. Department of Health and Human Services when it is checking compliance with HIPAA, and to a coroner or medical examiner

Uses that always require your written authorization

  • Psychotherapy notes: separate notes I may keep about our sessions receive extra protection. I will not share them without your authorization, except in the narrow situations the law allows: use by me for your treatment, defending myself in a legal action you bring, oversight of my practice, a serious and imminent threat to safety, or a coroner or medical examiner.
  • Marketing: I will never use your information for marketing.
  • Sale of information: I will never sell your information.
  • Any other use not described in this notice.

You may revoke an authorization in writing at any time, except for information already shared in reliance on it.

Your rights

You have the right to:

  • See and get a copy of your records, on paper or electronically. I will respond within 30 days and may charge a reasonable, cost-based fee as allowed by law. In rare cases I may deny access, and I will explain in writing how you can have that decision reviewed.
  • Ask me to correct your records if you believe something is wrong or missing. I will respond within 60 days. If I deny your request, you may submit a statement of disagreement.
  • Ask me to limit how I use or share your information. I am not required to agree, except that if you pay for a service in full out of pocket and ask me not to share it with your health plan, I must agree.
  • Ask for confidential communication, such as contact at a different phone number or address. I will agree to reasonable requests.
  • Get a list of disclosures I have made of your information for purposes other than treatment, payment, and health care operations, covering up to six years. The first list each year is free.
  • Be notified of a breach if your unsecured information is ever compromised.
  • Choose someone to act for you, such as a legal guardian or someone with power of attorney.
  • Get a paper copy of this notice at any time, even if you received it electronically.

Changes to this notice

I may change this notice, and changes will apply to all information I hold. The current version is always posted on this website and available on request.
